Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Postcast web application (the "Service") operated by Postcast ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Account Registration

• You must provide accurate, complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You may not share your account with others or create multiple accounts
• We reserve the right to suspend or terminate accounts that violate these Terms

3. Description of Service

Postcast allows you to connect your YouTube and/or Vimeo accounts, select videos, and generate AI-powered summaries, highlights, transcripts, clip suggestions, and podcast feeds ("Casts") from your video content.

4. Third-Party Platform Connections

4.1 YouTube

By connecting your YouTube account, you authorize Postcast to access your YouTube channel data in read-only mode through the YouTube API Services. Your use of YouTube data through our Service is also subject to YouTube's Terms of Service and Google's Privacy Policy.

4.2 Vimeo

By connecting your Vimeo account, you authorize Postcast to access your Vimeo account data in read-only mode through the Vimeo API. Your use of Vimeo data through our Service is also subject to Vimeo's Terms of Service.

4.3 Disconnecting

You may disconnect your YouTube or Vimeo account at any time from your dashboard. Disconnecting will remove the stored OAuth credentials. Previously generated Casts will remain unless you delete them.

5. Your Content

5.1 Ownership

You retain ownership of all content you submit to or generate through the Service, including your videos, transcripts, and Casts. We do not claim ownership of your content.

5.2 License to Us

By using the Service, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service to you.

5.3 Responsibility

You are responsible for ensuring you have the right to submit content to the Service. You must not submit content that infringes on the intellectual property rights of others, contains illegal material, or violates any applicable law.

6. AI-Generated Content

The Service uses artificial intelligence to generate summaries, highlights, and other derivative content. You acknowledge that:

• AI-generated content may not always be accurate or complete
• You are responsible for reviewing and editing AI-generated content before publishing or sharing it
• We do not guarantee the accuracy, quality, or suitability of AI-generated content

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service's operation
• Scrape, crawl, or use automated means to access the Service except through our provided interfaces
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to process content you do not own or have rights to
• Resell, sublicense, or redistribute the Service without our written consent
• Circumvent any rate limits, access controls, or security features

8. Subscription and Payment

Certain features of the Service may require a paid subscription. Payment terms, pricing, and cancellation policies will be presented to you at the time of purchase. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

9. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage arising from Service downtime.

10. Termination

• You may delete your account at any time from your account settings
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your data will be permanently deleted in accordance with our Privacy Policy

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTCAST AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Indemnification

You agree to indemnify and hold harmless Postcast and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
